Respondents in a southern state telephone survey agreed that media coverage of public leaders' private lives is an important news media responsibility, with agreement greater for legacy media than for online media, and differing depending on hypothetical scenario. The data also suggest increasing tolerance for such coverage and growing belief in responsibility of media to report on private indiscretions relative to previous studies.

In the following paper sources of a constitution are put in question in general, and more specifically, the constitutional culture of the European Union Law is being investigated in-depth with regard to principles of deliberative democracy and rulings of the Court of Justice of the European Union. The change of a law application paradigm as well as the change of a legal systems’ nature are taken into account.

[ENG] The aim of this paper is to analyze the „possibility puzzle” presented by Shapiro (2011) in the context of the debate between conventionalism and non-conventionalism in speech act theory. Conventionalism claims that for every speech act there is a pattern (convention) which determines its illocutionary force. To perform a felicitous speech act is to fulfil necessary and sufficient conditions for this particular speech act. Non-conventionalism criticizes the view that for every speech act there is a conventional pattern and hidden (...) conditions, which are to be fulfilled. This view maintains the conventional thesis for the so-called strict conventional speech acts (e.g. performatives), but negates using universal quantifier for so-called communicative speech acts whose aim is, in short, to express an intention and force someone to act by virtue of this intention. As in (Shapiro 2011), Phil said: in order for someone to have the power to make, change and apply rules, there has to be a rule that empowers someone to do so. This objection concerned „The First Legis- lator” only from the conventional perspective on speech acts. If it can be maintained that The First Legislator’s speech acts may be non-conventional, then Phil’s argument misses the point. Finally, I will emphasize that only lawyers analyze „the very first speech acts” whereas for philosophers, the problem of e.g. „the very first question” is less absorbing. -/- [PL] Celem niniejszego artykułu jest przedstawienie tak zwanej Aporii Phila (possibility puz- zle) przedstawionej przez Shapiro (2011) w kontekście sporu konwencjonalizm–nonkon- wencjonalizm w teorii aktów mowy. Konwencjonalizm utrzymuje, że dla każdego aktu mowy istnieje konwencja, która determinuje moc illokucyjną aktu. Wykonać w pełni for- tunny akt mowy to spełnić wystarczające i konieczne warunki określone dla danego aktu mowy. Nonkonwencjonalizm krytykuje pogląd, że dla każdego aktu mowy istnieje okre- ślona konwencja oraz ukryte warunki, które należy spełnić. Ten pogląd utrzymuje kon- wencjonalną tezę dla tak zwanych stricte konwencjonalnych aktów mowy (na przykład performatywów), ale neguje użycie dużego kwantyfikatora dla tak zwanych komunika- cyjnych aktów mowy, których celem jest, w skrócie, wyrażenie pewnej intencji i zmusze- nie kogoś poprzez jej wyrażenie do określonego postępowania. Phil, bohater historii z książki Shapiro (2011), podkreślił, iż zawsze musi istnieć reguła upoważniająca do two- rzenia prawa. Ten zarzut dotyczący „Pierwszego Legislatora” jest zasadny tylko z per- spektywy konwencjonalizmu. Jeżeli można utrzymywać, że akt mowy Pierwszego Legislatora może być nonkonwencjonalny, wtedy argument Phila jest nietrafny. Na końcu scharakteryzowany jest następujący fenomen: tylko prawnicy analizują „pierwsze akty mowy”, natomiast dla filozofów problem „pierwszego pytania” nie jest tak absorbujący. (shrink)

The aim of the present article is to reconstruct the theory of the moral perception held by G.E. Moore, with a special regard to its ontological and epistemological features. The author tries to prove first that Moore’s theory of ethical reality has been strongly influenced by his ontology and epistemology. Secondly, he indicates that the two mentioned views are interdependent ones. However the article is intended not only to give an account of the doctrine of Moore but also to be (...) a particular interpretation of it. A discerning analysis of Moore’s act of the moral perception shows that he understood it on the analogy with the sense perception. The author tries therefore to interpret the theory of the moral perception in the sense-data language. (shrink)

The chapter discusses potential benefits of corpus analysis in philosophical investigations, in particular in experimental philosophy. Philosophers often assume that what happens in language is crucial for the analysis of concepts of philosophical interest. In doing so, they commonly appeal to their own linguistic intuitions, which has been claimed to be methodologically dubious (Bluhm 2013, 2016). Bluhm’s own model of philosophical research has a place for corpus analysis. However, the model has some limitations. I present an alternative model for the (...) use of corpus analysis in philosophical research that can be especially useful for experimental philosophy. As an example, I examine Shepard and Wolf (2013) study on the causal structure of Knobe scenarios. Corpus analysis can be used to show that the verb “cause” used in their scenarios has a negative aura. I discuss the implications of this fact for the design of further studies. (shrink)

Surveys are the most widely used research tool in experimental philosophy. In this paper, I analyze two types of criticism of the questionnaire method put forward in the literature. The first type is metaphilosophical. It asserts that the surveys used by experimental philosophers are based on a flawed and unproductive method of cases. The second type is methodological. It argues that currently used questionnaires are unfit to measure philosophically relevant phenomena. I show that these objections can be met by a) (...) improving questionnaires used in research practice and b) expanding the methodological repertoire of experimental philosophy. (shrink)

Weingarta, wydanej w 2020 r. W tekście przedstawiam książkę jako udaną propozycję uhumanistycznienia nauk o sieci, oceniając poszczególne rozdziały i sytuując tę pracę w kontekście zastanej już literatury oraz zapotrzebowania.

Barcz and Zaręba (2021) argue that depending on the shape and the size of the asymmetry in attributions of intentional actions one can distinguish various interpretations of the Knobe effect. Their classification of these interpretations can be used to compare judgments of intentional action across different languages and cultures. Our study in three languages (Polish, English and Italian) indicates that there is some cross-cultural variation both in the ascription of intentionality to an action and in the ascription of actions to (...) the agent. "Richard Burthogge's Conceptualism and Its Origins in the Medieval Perspectivist Optics" The paper aims to analyse the historical determinants of the conceptualist argument for epistemological idealism made by the seventeenth-century English philosopher Richard Burthogge. The crux of this argument, unprecedented in earlier philosophy, is an attempt to prove the inherent inadequacy of human cognition from the divergence between the general concepts and the extra-mental singulars. At the same time, Burthogge considers the relationship between the universal and the particular to be (...) analogous to the relation between the visual image and the thing. I argue that, as suggested by certain significant aspects of Burthogge’s theory, it was medieval perspectivist optics that had decisively influenced the conception of visual cognition, which provided the basis for this analogy and, consequently, for the conceptualist argument itself. Social constructivists use to say that economists cannot study objective reality, absolute truth does not exist, and economic knowledge is being constructed, not discovered and it depends on temporary culture. Realists notice and admit social conditions which may affect economic theories and unrealistic assumptions of models, but they claim that these models describe the real world, at least to some extent. "The Problem of Intersubjectivity in Berkeley’s Immaterialism" The paper discusses the issue of intersubjectivity in Berkeley’s early philosophy. In the course of metaphysical analysis I argue that it is not possible to save within Berkeleian metaphysics intersubjectivity of the object of cognition and the unity of the world of experience, either in version of its strict identity or by taking perfect likeness as a criterion of its identity.

"Theory of modus concipiendi in Richard Burthogge’s Epistemology" The paper focuses on the epistemology of Richard Burthogge, the lesser known seventeenth-century English philosopher and author, among other works, of the Organum Vetus & Novum (1678) and An Essay upon Reason and the Nature of Spirits (1694). Although his ideas had a minimal impact on the philosophy of his time, and have hitherto not been the subject of a detailed study, Burthogge’s writings contain a highly original concept of idealistic constructivism. The (...) most important claim of this approach is that the external objects are never presented to the mind directly, as they are in themselves, but always under the modus concipiendi, a particular form of conceiving or conceptualising, performed by the human cognitive powers (both intellectual and sensuous) in the manner and with the means determined by their structural and functional properties. Thus, Burthogge clearly anticipates Kant in claiming that the external world is unknowable in itself, being accessible to the human mind only through the phenomena that the mind itself co-produces. The paper provides an outline of the theory of modus concipiendi, including its historical context and idealistic consequences, preceded by the brief presentation of Burthogge’s epistemology. "Subjectivisation of Sense Perception and Two Models of Early Modern Idealism" The distinction between primary and secondary qualities, most famously outlined by Galileo, and subsequently supported, inter alia, by Descartes and by Locke has widely been considered one of the crucial factors in the development of modern idealism. In its contemporary form, the distinction identifies some of the perceived properties as mental phenomena due to their content and structural dependence on the mind. However, this account of the primary/secondary distinction is (...) largely different from its original version developed by the above-mentioned philosophers, within whose work the mental being of the perceived qualities was demonstrated objectively, from the conceptually-derived nature of matter, and not subjectively, by referring to the mind’s participation in the cognitive process. It was only at the next stage of the early modern subjectivisation of sense perception, best exemplified by such philosophers as Arnold Geulincx and Richard Burthogge, that the creative role played by the mind in sensation and, consequently, the mind-dependency of the sensible qualities was recognised – a turn influenced by the reinterpretation of Aristotelian philosophy offered by Jacopo Zabarella and Paduan school as well as by Anti-Aristotelianism of the kind developed in Netherlands. Furthermore, the two different approaches to the primary/secondary distinction can be linked with two main types of post-Cartesian idealism, i.e. Berkeleian and Kantian – a claim for which illustrative evidence from British philosophy, namely from Berkeley’s and Burthogge’s respective theories, can be drawn. "A Special Case of Logical Contradiction – Content Implication Approach" The difference between so-called performative/pragmatic and logical contradiction seems to be one of the most firmly established philosophical distinctions. There are, however, some utterances, which fall outside this classification in its current form. Moreover, they reveal that the expressive power of the language of classical logic is too weak to express some form of the logical contradiction. The main aim of this paper is to characterize this special case of the (...) contradiction. By extending classical logic with a new connective, i.e. content implication, it also provides tools needed for adequate formal representation of this phenomenon. (shrink)

W 1964 roku Herbert Marcuse postawił słynną tezę o jednowymiarowości współczesnego człowieka. Stanowi ona jedną z jego najważniejszych koncepcji teoretycznych, a także rozwinięcie tezy postawionej przez Marcusego już w 1937 roku w eseju O afirmatywnym charakterze kultury. Celem mojego artykułu jest krytyczna rewizja tej koncepcji. Z jednej strony kapitalizm kognitywny wzmocnił mechanizmy kontroli zachowań konsumenckich. Z drugiej strony społeczeństwo ponowoczesne jest jednak refleksyjne: produkcja wiedzy i samowiedzy ma w nim charakter systemowy. Połączenie tych dwóch procesów prowadzi – jak twierdzę – (...) do wytworzenia raczej dwubiegunowej niż jednowymiarowej jednostki oraz kultury. Represywna desublimacja idzie dziś w parze z refleksyjnością. W rezultacie, podmiot ponowoczesny to akratyk – człowiek systematycznie postępujący wbrew własnej woli. W drugiej części tekstu dowodzę, że dwubiegunowa struktura ponowoczesnego podmiotu tworzy warunki sprzyjające rozwojowi współczesnego populizmu. (shrink)

W latach 80. i 90. ubiegłego stulecia pojęcie postmodernizmu budziło skrajne emocje. Po jednej stronie lokowali się kpiarze i skrajni sceptycy, którzy uznali pisarstwo postmodernistyczne za humbug i wytwór intelektualnej mody. Po drugiej stronie znajdowali się ci, którzy w postmodernizm uwierzyli aż za bardzo, widząc w nim festiwal wszelkich różnic, a zarazem nadejście długo wyczekiwanego królestwa wolności. Czym był jednak w swej istocie ów straszny bądź ekscytujący postmodernizm? I czy nie nadszedł już czas, by spojrzeć na tę sprawę odrobinę chłodniejszym (...) okiem? W Polsce wydaje się to tym bardziej wskazane, że tematykę postmodernizmu i ponowoczesności rozwijali w swych pracach głównie anglosascy marksiści, których twórczość została w naszym kraju po 1989 roku niesłusznie, choć ze zrozumiałych względów zaniedbana. Bohaterowie Goodbye Mr. Postmodernism to Perry Anderson, David Harvey, Fredric Jameson, Terry Eagleton oraz Slavoj Žižek, których autor umieszcza pod wspólnym szyldem „późnej lewicy". Książka stanowi zarazem encyklopedyczne wprowadzenie do ich teorii, jak i próbę uchwycenia nowego klimatu lewicowej myśli, która manierze wiecznej emancypacji oraz upodobaniu do kolorowych marginesów (wspólnym postmodernizmowi i "nowej", zrodzonej pod koniec lat sześćdziesiątych lewicy) coraz częściej przeciwstawia skłonność do odpowiedzialnej etycznie refleksji. Problematyka artykułu skupia się wokół zagadnienia awataryzacji w kontekście transhumanistycznej koncepcji cyberimmortalizmu. Awataryzacja jest omawiana jako proces uobecniania się człowieka pod postacią cyfrową, czego ostatecznym etapem ma być – według niektórych transhumanistów i futurystów – wyłonienie się cyfrowego post-człowieka. Celem artykułu jest charakterystyka cyberimmortalizmu na tle innych transhumanistycznych nurtów oraz omówienie wyzwań związanych z ideą transferu umysłu (antropologicznych, metafizycznych oraz społecznych).

Artykuł jest próbą konceptualizacji procesu przekształcania się rzeczywistości człowieka pod wpływem rozwoju technologii cyfrowych. Ich wzrastająca obecność w codziennym życiu doprowadziła do zatarcia granic między tym, co wirtualne, a tym, co realne. Proces ten postępuje, w wyniku czego można mówić o przekształceniu się ludzkiej rzeczywistości w bimodalną hybrydę. Jest to efektem, z jednej strony, procesu przenikania tego, co charakterystyczne dla realności, do rzeczywistości wirtualnej, z drugiej – procesu łączenia się wirtualności i realności w jednym bycie (tzw. hybrydyzacja bimodalna.

“Il n’y a pas de hors-texte”. Intralinguistic Semantics and Its Philosophical and Cognitive Consequences The aim of this paper is to present and metatheoretically analyse the model of intralinguistic semantics as set forth by Umberto Eco in his Theory of Semiotics. The distinctive feature of this system is the rejection of the realistic category of reference, understood as a correspondence of meaningful units with the extralinguistic domain of interpretation, i.e., with a class of extralinguistic semantic correlates. As a result, the (...) main idea of Eco’s theory is to replace the traditional extralinguistic semantics with the new one, in which the meaning of each unit is determined solely by its relations with the other elements of the system. Language formed in this way is semantically autonomous, intralinguistically closed and self-explaining. Analysis of Eco’s theory by means of the appropriate conceptual apparatus reveals the far-reaching philosophical and cognitive implications of his approach in studies on language, meaning and truth. Mimo ujmującej prostoty filozofia Berkeleya pozostaje przedmiotem niekończących się sporów interpretacyjnych. Toczą się one przede wszystkim wokół dwóch ściśle związanych ze sobą zagadnień. Po pierwsze, od dziesiątków lat spór między badaczami dotyczy kwestii właściwej klasyfikacji berkeleyowskiej filozofii – zażarte debaty wywołuje pytanie o to, czy należy uznać ją za system idealistyczny czy raczej realistyczny? Powodu do tego sporu dostarczył sam Berkeley, który redukując cały świat doświadczenia do zespołu istniejących jedynie w umyśle idei, zarazem wielokrotnie zapewniał, że owo upodmiotowienie rzeczywistości nie (...) przynosi w najmniejszym stopniu uszczerbku jej realności. Kontrowersja ta jest jednak tylko pochodną bardziej fundamentalnej kwestii – pytania o metafizyczną strukturę berkeleyowskiej idei. Nic więc dziwnego, że oba te zagadnienia zdominowały dwudziestowieczne studia nad myślą Berkeleya. Jakie są perspektywy zakończenia tych sporów? Czy możliwe jest rozstrzygnięcie obu wymienionych kwestii? Niewątpliwie. Niemożliwe jest jednak osiągnięcie tego celu metodami czysto historycznymi. Jego realizacja wymaga zmiany postawy metodologicznej, która „spór o Berkeleya” pozwoliłaby przenieść na bardziej teoretyczny grunt. Niniejsza książka ma spełnić właśnie taką rolę. (shrink)

The paper critically examines the conception of majoritarian democracy. In the second part of the text, the author introduces the definition of majoritarian democracy based on the Joseph Schumpeter’s theory of minimal democracy. The thesis of the paper is that electing the government by universal suffrage is neither necessary nor sufficient as a condition for a democratic regime. The concept of democracy is broader, including the catalogue of democratic values connected with the concept of democratic citizenship, special circumstances of political (...) action and the limitation of government powers. According to the expertise defense, practitioners of the method of cases need not worry about findings that ordinary people’s philosophical intuitions depend on epistemically irrelevant factors. This is because, honed by years of training, the intuitions of professional philosophers likely surpass those of the folk. To investigate this, we conducted a controlled longitudinal study of a broad range of intuitions in undergraduate students of philosophy (n = 226), whose case judgments we sampled after each semester throughout their studies. Under the (...) assumption, made by proponents of the expertise defense, that formal training in philosophy gives rise to the kind of expertise that accounts for changes in the students’ responses to philosophically puzzling cases, our data suggest that the acquired cognitive skills only affect single case judgments at a time. There does not seem to exist either a general expertise that informs case judgments in all areas of philosophy, or an expertise specific to particular subfields. In fact, we argue that available evidence, including the results of cross-sectional research, is best explained in terms of differences in adopted beliefs about specific cases, rather than acquired cognitive skills. We also investigated whether individuals who choose to study philosophy have atypical intuitions compared to the general population and whether students whose intuitions are at odds with textbook consensus are more likely than others to drop out of the philosophy program. Brandom (Citation1994) made inferentialism an intensely debated idea in the philosophy of language in the last three decades. Inferentialism is a view that associates the meaning of linguistic expression with the role said expression plays in inferences. It seems rather uncontroversial that the correct theory of meaning should distinguish between linguistic correctness and factual correctness. For instance, speaker S can be wrong in saying ‘I have arthritis’ in two distinct ways: (i) S fails to apply a word correctly to make (...) a true statement due to having made a factual error, and (ii) S uses an expression incorrectly because they are wrong about its meaning. In this paper, I show that properly understood normative inferentialism can make room for such a distinction. I propose that linguistic correctness is a structural issue: linguistic mistakes stem from the improper or insufficient acquisition of an inferential role. Factual correctness, on the other hand, is a one-off issue of the correct application of inferential rules to a particular situation. I argue that, by tying the issue of correctness to the game of giving and asking for reasons, inferentialism can establish a reliable method for distinguishing between two types of correctness (and mistakes).
